You can make a proposal to clear arrears on your mortgage or secured loan. Legally you can, if required, pay the arrears back over the remaining term of the mortgage but this is not a given and certainly the lender is unlikely to agree to this. Most lenders will want to see arrears cleared over two or three years. This is why we often advise clients that it is in their interest to go to court either at the first hearing or on an application hearing as the court are far more likely to be understanding an give as much time as possible to clear the arrears over a longer period.
In most cases it is possible to make a proposal to clear arrears and stop an eviction with only hours to spare but the longer we have the better to prepare your case and ensure that we have a detailed understanding of your circumstances that have caused you to be facing eviction and how your situation has now improved.
